« Cabinet Arc really won me over with the way they set up our working framework, for two reasons: the first is that together we defined what our working framework was and consequently we have a charter we both signed concerning how I want recovery to be carried out, and also the way it has to return the funds to me and how we communicate with each other in order to ensure rapid return cashflow.

Then, via this charter, we gave priority to dematerialisation. The dematerialisation applied to all of our invoices, which we no longer send, but which it looks up on the Web site we have them on, which means there was some modelling which enabled it to make some savings and that enables us to have a win-win relationship.

So the specific features involved are clearly the possibility of setting up two types of disputes scenario: a disputes scenario which may be very legal, or in other words immediate legal proceedings; and a disputes scenario which may be more flexible, which enables negotiations and the establishment of interest on overdue payments, once again in keeping with this aspect of supporting the customer.

What truly won me over was the sophisticated legal knowledge that Cabinet Arc has; the firm knows how to use the right procedure, carry out conservatory seizures, as they explained to me, and enable funds to be returned quickly. »

The stakes involved in recovery are major ones, particularly in a line of business which is currently difficult.

Therefore, there are two impacts: the LME (Economic Modernisation Law) since you have an exemption agreement that the deadlines for payments that you have to collect upon the implementation of the LME are in effect; and the second stake is effectively continuing to reduce our late payments whilst remaining close to our customers because if a customer (as I just said) is having problems, you need to assess with the customer whether these problems are temporary ones or major ones.»

The European order for payment revolution

Jérôme Mandrillon is a judge at the Nanterre commercial court and a credit manager in the public works group Lafarge. He shares his thoughts with us about the European level recovery procedures.

What is your opinion of the new regulations that have been put in place in the European Union ?

Jérôme Mandrillon : Withdrawing the exequatur procedure is definitely progress for European law and saves a great deal of time in registering debt recovery applications. But what could be considered a real revolution is the European order for payment.

In what way is it a revolution ?
J. M. : To tell the truth, dematerializing documentary evidence is the real issue: with the certification already proposed by organizations such as Certigreffe, it is possible to complete an order for payment application on line and will soon be easy to formalize it completely in the same way. It will make the debt recovery procedure and the enforcement of judicial rulings even more efficient.

Does Lafarge use Cabinet Arc ?
J. M. : We have very few inter-state disputes, but we work on various cases with Cabinet Arc. I have known the company for nearly fifteen years and appreciate how conscientiously and swiftly it works. We can count on the Cabinet Arc lawyers to adapt to the speed required for each case and in real time we are able to monitor developments and the point the proceedings have reached.
